보건부, 대체 흡연 제품의 불법 수입 및 불법 흡연 근절 조치
보건부 산하 담배·주류통제국(TACO)은 담배 규제 관련 법규 위반 행위에 대한 단속을 강화하고 있다. 9월 2일, 한 여성이 공항에서 대체 흡연 제품(ASP)을 불법으로 수입한 혐의로 체포되어 기소되었다. 또한 침사추이에서는 금연 구역 내 물담배 불법 흡연 단속 작전이 실시되어 5건의 과태료 통지서(FPN)가 발부되었다.
-대체 흡연 제품 불법 수입
홍콩 세관으로부터 일본에서 입국한 여성의 수하물에서 대체 흡연 제품 20,600개가 적발되었다는 통보를 받았다. 통제국은 해당 여성을 체포하고 서구룡 치안법원에서 3개월 징역형을 선고받았다.
대량의 대체 흡연 제품 수입과 관련된 30건의 사건을 기소했다. 32명이 유죄 판결을 받고 4주에서 8개월에 이르는 징역형을 선고받았다.
수출입 조례(제60장)에 따르면, 전자담배, 가열식 담배, 허브 담배 등 대체 흡연 제품을 수입하는 자는 범죄를 저지른 것으로 간주되어 약식 재판에서는 50만 홍콩달러의 벌금과 2년 이하의 징역형에, 정식 재판에서는 200만 달러의 벌금과 7년 이하의 징역형에 처해질 수 있다.
흡연(공중보건) 조례(제371장)에 따라 누구든지 상업적 목적으로 대체 흡연 제품을 홍보, 제조, 판매 또는 소지할 수 없다. 위반자는 5만 홍콩달러의 벌금과 6개월 이하의 징역에 처해진다.
- 금연 구역 내 물담배 불법 흡연
통제국은 9월 3일 침사추이에서 단속을 실시해 두 곳의 바에서 물담배를 불법으로 피우던 세 명에게 벌금 통지서를 발부했으며, 바 내부에서 가열식 담배 제품을 흡연 및 소지하던 한 명에게도 벌금 통지서 두 장을 발부했다.
2024년 1월부터 현재까지 보건부는 실내 금연 구역에서 물담배를 불법으로 피운 사람들에게 총 약 300건의 벌금 통지서를 발부했으며, 실내 금연 구역에서 흡연을 방조한 바 직원 약 150명에게도 소환장을 발부했다.
본 조례에 따라 법정 금연 구역(예: 술집이나 식당의 실내)에서 흡연하는 것은 금지된다. 법정 금연 구역에서 흡연하는 사람은 3,000 홍코달러의 고정 벌금에 처해진다. 또한, 술집을 포함한 흡연 관련 제품(물담배 포함)을 판매하는 곳에서는 본 조례에 명시된 흡연 관련 제품의 판촉 및 판매 제한이 적용된다. 위반자는 약식 재판에서 최대 50,000홍콩달러의 벌금형에 처해질 수 있다.
전자담배 캡슐, 액상, 히트 스틱, 허브 담배 등 특정 흡연 관련 제품을 공공장소에서 소지하는 사람은 3,000달러의 고정 벌금에 처해진다.
Department of Health Takes Measures to Eradicate Illegal Imports of Alternative Smoking Products and Illegal Smoking
The Tobacco & Alcohol Control (TACO) under the Department of Health is intensifying its crackdown on violations of tobacco regulation laws. On September 2, a woman was arrested and charged at the airport for illegally importing alternative smoking products (ASP). Additionally, a crackdown operation on illegal hookah smoking within non-smoking zones in Tsim Sha Tsui resulted in the issuance of five Financial Failure Notices (FPNs).
- Illegal Import of Alternative Smoking Products
Hong Kong Customs received notification that 20,600 alternative smoking products were seized in the luggage of a woman arriving from Japan. The Control Department arrested the woman, who was sentenced to three months in prison by the West Kowloon Magistrates' Court.
Thirty cases related to the large-scale import of alternative smoking products were prosecuted. Thirty-two individuals were found guilty and sentenced to prison terms ranging from four weeks to eight months.
**Department of Health Takes Measures to Eradicate Illegal Imports of Alternative Smoking Products** According to the Import and Export Ordinance (Chapter 60), anyone importing alternative smoking products, such as electronic cigarettes, heated tobacco products, or herbal tobacco, is deemed to have committed a crime and may face a fine of HK$500,000 and imprisonment of up to two years in summary trials, or a fine of HK$2 million and imprisonment of up to seven years in formal trials.
Under the Smoking (Public Health) Ordinance (Chapter 371), no one is permitted to promote, manufacture, sell, or possess alternative smoking products for commercial purposes. Violators are subject to a fine of HK$50,000 and imprisonment of up to six months.
- Illegal Hookah Smoking in Non-Smoking Areas
On September 3, the Control Bureau conducted a crackdown in Tsim Sha Tsui and issued fine notices to three individuals illegally smoking hookah at two bars, as well as two fine notices to one individual who was smoking and possessing heated tobacco products inside a bar. From January 2024 to the present, the Department of Health has issued a total of approximately 300 fine notices to individuals who illegally smoked hookah in indoor non-smoking areas, and has also issued summonses to about 150 bar employees for aiding and abetting smoking in such areas.
Under this Ordinance, smoking is prohibited in statutory non-smoking areas (e.g., the interiors of bars or restaurants). Anyone smoking in a statutory non-smoking area is subject to a fixed fine of HK$3,000. Additionally, the restrictions on the promotion and sale of smoking-related products specified in this Ordinance apply to establishments selling smoking-related products (including hookah), including bars. Violators may be subject to a fine of up to HK$50,000 in summary proceedings.
Anyone possessing certain smoking-related products, such as e-cigarette capsules, liquids, heat sticks, or herbal tobacco, in public places is subject to a fixed fine of HK$3,000.
