건물주, 철거 명령 불이행 벌금형 선고
지난 금요일(8월 7일), 툰문 지방법원에서 한 건물주가 건축 조례(BO)(제123장)에 따라 발부된 철거 명령을 준수하지 않은 혐의로 유죄 판결을 받고 총 10만 2,600 홍콩달러의 벌금을 부과받았다. 이 중 6만 2,600달러는 위반 행위가 지속된 일수에 대한 벌금이다.
위엔롱 D.D. 115번지에 있는 부지에 무허가로 지어진 건물과 지붕 위 구조물과 관련된 것으로. 토지국에서 무허가 건축물(UBW)에 대한 면제 증명서를 발급하지 않았다.
건축국(BD)의 사전 승인 및 동의 없이 UBW가 진행되었기 때문에, 건축 조례 제24조(1)항에 따라 건물주에게 철거 명령이 내려졌으나 철거 명령을 이행하지 않은 건물주는 건축국(BD)에 의해 기소되었다.
정당한 사유 없이 철거 명령을 준수하지 않는 것은 건축법(BO)에 따라 중대한 범죄이다. 유죄 판결 시 최대 20만 홍콩달러의 벌금과 1년 이하의 징역형에 처해질 수 있으며, 위반 행위가 지속되는 매일 최대 2만 달러의 추가 벌금이 부과될 수 있다.
Building Owner Fined for Failure to Comply with Demolition Order
Last Friday (August 7), at the Tuen Mun District Court, a building owner was found guilty of failing to comply with a demolition order issued under Chapter 123 of the Building Ordinance (BO) and was fined a total of HK$102,600. Of this amount, HK$62,600 is a fine based on the number of days the violation continued.
The case involves an unauthorized building and a roof structure built on a site at 115 Yuen Long D.D. The Land Department did not issue a certificate of exemption for the Unauthorized Building (UBW).
Because the UBW proceeded without the prior approval and consent of the Building Department (BD), a demolition order was issued to the building owner pursuant to Article 24(1) of the Building Ordinance; however, the building owner, who failed to comply with the demolition order, was prosecuted by the Building Department (BD).
Failure to comply with a demolition order without just cause is a serious crime under the Building Ordinance (BO). If convicted, a fine of up to 200,000 Hong Kong dollars and imprisonment for up to one year may be imposed, and an additional fine of up to 20,000 dollars may be imposed for each day the violation continues.
