3,100만 당첨 Mark Six 복권 공동구매 동료 분쟁
홍콩 식품환경위생서(FEHD) 소속 위생 검사관이 14명의 직장 동료들과 공동 구매해 3,100만 홍콩달러에 당첨된 마크식스 복권 당첨금을 가로채려 한 혐의로 경찰 조사를 받고 있다. 그는 당첨금 중 1,000만 홍콩달러를 자신의 몫으로 요구한 뒤 장기 휴가를 내고 자취를 감췄다.
홍콩로컬매체에 따르면, 이번 분쟁은 지난 토요일 홍콩 자키 클럽이 주관한 마크식스 50주년 기념 '스노우볼 추첨에서 역대 최고액인 2억 2,800만 홍콩달러의 당첨금이 걸린 가운데 발생했다.
소식통에 따르면, 웡축항(Wong Chuk Hang)에 위치한 해당 부서의 '시장 활성화과(Market Revitalisation Section)' 동료 14명이 돈을 모아 공동 구매한 복권이 1등 당첨금의 절반을 차지하는 행운을 안았다.
소식통에 따르면, '링(Ling)'이라는 성을 가진 위생 검사관이 동료들로부터 '멀티플 뱅커베팅 전략을 활용해 복권을 구매해 달라는 부탁을 받았다.
공동 구매 그룹을 대표해 3,160만 홍콩달러가 넘는 당첨금을 수령한 직후, 링은 즉시 부서에 휴가를 신청했다.
3일 후, 링은 동료들에게 연락해 자신이 당첨의 핵심인 번호를 직접 선택했으므로 1,000만 홍콩달러라는 더 큰 몫을 가져야 한다고 주장하고 나머지 금액만 다른 참가자가 똑같이 나눠 가져야 한다고 제안했다.
동료들이 이 배분안을 거부하고 14명이 똑같이 나눌 것을 요구하자, 링은 이미 당첨금 전액을 은행 정기 예금에 묶어두었다고 주장하며 자금 지급을 거부했고 동료들은 경찰에 신고했다.
문제가 된 복권은 1억 8,500만 홍콩달러의 특별 스노우볼 기금이 걸려 큰 기대를 모았던 9월 5일 마크식스 50주년 기념 스노우볼 추첨(2차)의 일환으로 구매된 것이었다.
홍콩에서는 복권 공동 구매 당첨금 배분을 둘러싼 분쟁으로 인해 형사 처벌을 받은 사례가 있다. 2007년, 한 식당에서 친구로부터 '마크 식스(Mark Six)' 복권 구매를 부탁받았던 남성이 해당 복권이 3등(당첨금 3만 8,000홍콩달러)에 당첨되자 당첨금을 가로채 도주한 사건이 있었다.
경찰 신고와 형사 기소 끝에 피고인은 징역 6주를 선고받았으나, 당첨금은 반환하지 못했다.
법률 전문가들은 복권 구매 비용과 당첨금을 공유하기로 한 구두 합의도 법적 구속력이 있는 계약에 해당한다고 지적한다.
타인에게 위탁받은 복권 당첨금을 부정한 방법으로 가로챌 경우 절도 또는 사기 혐의로 형사 처벌을 받을 수 있으며, 유죄 판결 시 최대 10년의 징역형에 처해질 수 있다.
변호사들은 소유권 분쟁을 예방하기 위해 공동 구매 참여자들이 항상 서면 기록, 서명된 합의서, 복권 사본 등을 보관해야 한다고 조언했다.
Dispute Among Colleagues Over HK$31 Million Mark Six Lottery Win
A health inspector from Hong Kong's Food and Environmental Hygiene Department (FEHD) is under police investigation for allegedly attempting to misappropriate winnings from a Mark Six lottery ticket purchased jointly with 14 colleagues. The ticket won a total of HK$31 million; the inspector demanded HK$10 million as his share before taking extended leave and disappearing.
According to an exclusive report by the local Hong Kong media outlet *Sing Tao Headline*, the dispute arose following the Mark Six 50th Anniversary "Snowball" draw organized by the Hong Kong Jockey Club, which featured a record-breaking jackpot of HK$228 million.
Sources indicate that a group of 14 colleagues from the department's "Market Revitalisation Section" in Wong Chuk Hang pooled their money to buy the ticket, which successfully secured half of the first-prize jackpot.
According to the sources, the health inspector—surnamed "Ling"—had been asked by his colleagues to purchase the ticket using a "multiple banker betting strategy."
Immediately after collecting the winnings—totaling over HK$31.6 million—on behalf of the group, Ling applied for leave from the department.
Three days later, Ling contacted his colleagues and argued that he was entitled to a larger share of HK$10 million because he had personally selected the "banker" number, which was crucial to the winning combination. He proposed that the remaining amount be split equally among the other seven participants.
When his colleagues rejected this proposal and demanded an equal split among all 14 people, Ling refused to distribute the funds, claiming he had already locked the entire prize money into a bank time deposit; his colleagues subsequently reported the matter to the police.
The lottery ticket in question was purchased for the second "Mark Six" 50th Anniversary Snowball draw held on September 5, which had generated significant anticipation due to its HK$185 million special Snowball jackpot.
There have been previous cases in Hong Kong where disputes over the distribution of shared lottery winnings resulted in criminal penalties. In 2007, a man who had been asked by a friend at a restaurant to purchase a "Mark Six" ticket absconded with the winnings after the ticket won the third prize (HK$38,000).
Following a police report and criminal prosecution, the defendant was sentenced to six weeks in prison, though the prize money was never recovered.
Legal experts point out that a verbal agreement to share the cost of purchasing a lottery ticket and the resulting winnings constitutes a legally binding contract.
Dishonestly misappropriating lottery winnings entrusted by others can lead to criminal charges for theft or fraud, carrying a maximum penalty of 10 years in prison.
Lawyers advise that participants in group lottery purchases should always maintain written records, signed agreements, and copies of the tickets to prevent ownership disputes.
